Terms of Service

These Terms govern your use of the website and free resources at autocyberai.com. Commercial use of AutoCyber AI products (WASA AI, NAD AI, Spark AI, SecureEasy AI) and the CRP™ reference implementation is governed by a separate Master Services Agreement (“MSA”), Data Processing Agreement (“DPA”, GDPR Art. 28), and applicable Order Forms, which take precedence over these Terms for any conflict.
1. Definitions
“AutoCyber AI”, “we”, “us”, “our” means AutoCyber AI Pty Ltd (ABN 22 697 087 166), an Australian company. “You” means the individual or entity accessing the website. “Services” means our website, documentation, blog, and any free public resources. “Products” means our commercial AI products and the CRP™ reference implementation, governed separately.
2. Acceptance & Eligibility
By accessing the Services you agree to these Terms, our Privacy Policy, our Cookie Policy, our Information Security Policy, and our AI Policy. You must be at least 16 years old and have legal capacity. If you act on behalf of an organisation, you confirm you have authority to bind it.
3. Permitted Use of the Services
You may:
- browse the website and download publicly published content for evaluation;
- reference and cite our materials with attribution;
- subscribe to newsletters and join waitlists.
4. Prohibited Conduct
You must not:
- attempt to break, probe, or circumvent security controls without our written authorisation (see Information Security Policy for our coordinated disclosure programme);
- use the Services to develop, train, or fine-tune machine-learning models that compete with our Products (including scraping, mass extraction, or automated harvesting);
- perform any activity prohibited by EU AI Act Article 5 (e.g. manipulative or exploitative AI, social-scoring, real-time biometric identification in public spaces, emotion inference in workplace/education, predictive policing based solely on profiling, untargeted facial-image scraping);
- upload unlawful, infringing, harmful, or malicious content;
- interfere with availability, integrity, or confidentiality of the Services or other users;
- reverse-engineer, decompile, or attempt to derive the source code of any non-open-source Products;
- remove or obscure copyright, trademark, or other proprietary notices;
- misrepresent affiliation with AutoCyber AI.
5. Intellectual Property
All content on the website is © AutoCyber AI Pty Ltd unless otherwise stated. “AutoCyber AI”, “Context Relay Protocol”, “CRP” and associated logos are trademarks of Constantinos Vidiniotis / AutoCyber AI Pty Ltd (applications pending). The CRP™ protocol specification is open and free to implement under the terms published at crprotocol.io. The CRP reference implementation is licensed under the Elastic License 2.0. Nothing in these Terms grants you any right in our trademarks or non-open-source source code.
6. Third-Party Content & Links
The Services may link to third-party sites. We do not control and are not responsible for third-party content, policies, or practices.
7. AI Outputs & Transparency (EU AI Act Art. 50)
Some features may use AI to generate content, summaries, or recommendations. Where this is the case, we will tell you. AI outputs are provided for informational purposes only and may contain errors, omissions, or biases. You are responsible for independently verifying any AI output before relying on it for material decisions. We comply with EU AI Act Article 50 transparency obligations and label AI-generated content where required.
8. Newsletter & Communications
If you subscribe, you consent to receive newsletter and product updates. You can unsubscribe at any time via the link in any email or by emailing privacy@autocyberai.com.
9. Disclaimer of Warranties
The Services are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Services will be uninterrupted or error-free. To the extent any warranty cannot be excluded under the Australian Consumer Law or other non-excludable law, our liability is limited to the maximum extent permitted.
10. Limitation of Liability
To the maximum extent permitted by law, AutoCyber AI, its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or use, arising out of or related to your use of the Services, even if advised of the possibility of such damages. Where liability cannot be excluded, our aggregate liability for the Services is limited to AUD 100.
11. Indemnity
You agree to indemnify, defend, and hold harmless AutoCyber AI from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms, (b) your misuse of the Services, or (c) your violation of any law or third-party right.
12. Privacy & Security
Your privacy is governed by our Privacy Policy. Our security posture is described in our Information Security Policy (aligned with ISO/IEC 27001:2022 and the OWASP Top 10 (2025)). For commercial customers, a GDPR Art. 28 DPA applies on signature of an Order Form.
13. Termination
We may suspend or terminate your access to the Services at any time, without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. Sections 5, 9, 10, 11, 14, and 15 survive termination.
14. Governing Law & Jurisdiction
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-laws principles. The courts of New South Wales have exclusive jurisdiction. Nothing in these Terms limits rights you may have under non-excludable consumer law.
15. Changes
We may update these Terms. Material changes will be announced on this page with an updated Effective date. Continued use of the Services after the effective date constitutes acceptance.
